Terms of Use

1. Definitions and acceptance of the terms

These Terms govern the use of the Otklik service (website otcl1ck.ru; hereinafter — the “Service”), the rights holder of which is Индивидуальный предприниматель Балаганский Павел Сергеевич (INN 543807917255; hereinafter — the “Administration”). By registering and using the Service, the User confirms acceptance of these Terms and of the Privacy Policy.

The terms for the provision of paid services are set out in the Public offer.

2. Registration and account

To access the functions of the Service the User creates a business account. The User undertakes to provide accurate data and to keep it up to date, as well as to maintain the confidentiality of the login credentials. The User is responsible for all actions performed under their account.

3. Rules of use

When using the Service it is prohibited to:

• violate the legislation of the Russian Federation and the rights of third parties;
• send spam and messages without a legal basis and without the consent of the recipients;
• place unlawful, offensive or misleading content in the knowledge base, the scenarios and the messages;
• attempt to gain unauthorised access, disrupt the operation of the Service, examine its source code, decompile or copy it;
• resell or transfer access to third parties without the written consent of the Administration.

4. User content

The User independently compiles the knowledge base, the scenarios and the messages of the bot and bears full responsibility for their content and for having a legal basis for processing the personal data of its clients. The Administration does not carry out prior moderation of the content of the User, but has the right to restrict access if violations are detected.

The replies of the bot are generated using artificial intelligence technologies and may contain inaccuracies; the User is obliged to check that the settings and the resulting replies are correct.

5. Intellectual property

The Service, its program code, design, texts and other elements are the intellectual property of the Administration and are protected by law. The User is granted a limited, non-transferable right to use the Service within the selected plan. Content uploaded by the User remains its property.

6. Disclaimer of warranties and liability

The Service is provided “as is” and “as available”. The Administration makes reasonable efforts to keep it operational, but does not guarantee uninterrupted and error-free operation, nor the operation of third-party services (messengers, CRM systems, language model providers). The Administration is not liable for the lost profit of the User; the limits of liability are set out in the Public offer.

7. Changes to the Terms

The Administration has the right to amend these Terms. The current revision is always available on this page; material changes are communicated to Users through the Service. Continued use of the Service means acceptance of the changes.

8. Governing law and disputes

These Terms are governed by the legislation of the Russian Federation. Disputes are resolved through negotiations, and if no agreement is reached — in the manner established by the legislation of the Russian Federation.
